2023 Governing Document Amendment Vote

The Board of Directors is proposing a revision to the Association’s Governing Documents. Our lawyers have been recommending this for some time, as the law has changed in the more than two decades since this community was built. The world has changed as well; it’s probably not important to be able to send meeting notices by telegraph anymore, but it would be good to fully authorize electronic meetings.

This post contains links to our current documents, the proposed amended documents, and redline versions highlighting the differences between them. There have been only minor changes since they were posted for comment last year.

Of particular note is that there are two questions on the ballot:

  • Proposal A modernizes our three governing documents, and is recommended for approval by the Board.
  • Proposal B is a Co-owner proposal which shifts some of our monthly dues assessment to a flatter structure, effectively lowering them slightly for larger units, while raising them slightly for smaller units. The Board makes no recommendation regarding its approval. More details are provided in the summary document.

Ballots to vote on the Amendments have now been mailed to all of our Co-owners, and we ask that they be returned as soon as possible, as the law only allows a limited time for the vote, and any ballot not returned effectively becomes a ‘no’ vote on both proposals.
